1. LEGALLY BINDING AGREEMENTBy accessing, browsing, or using YOO POH ENG "Cafe Akaw" (hereinafter "Cafe Akaw," "We," "Us," or "Our") website, mobile app, in-store services, delivery platforms, social media, Wi-Fi, loyalty programs, or any interaction with Our business (collectively, "Services"), you ("Customer," "You," or "User") irrevocably agree to these Terms & Conditions (T&C), Privacy Policy, and all referenced policies. If You disagree, DO NOT use Our Services.
2. CHANGES TO TERMSWe reserve the absolute right to modify, amend, or replace these T&C at any time without prior notice.
Continued use after changes = Full acceptance.
Your sole responsibility to check for updates.
3. ELIGIBILITY & USER RESPONSIBILITIESMinimum Age: 18+ (or legal age in Your jurisdiction). No exceptions.
Account Security: If You create an account, You are 100% liable for all activities under it, including fraud.
Prohibited Conduct:
No fake accounts, fraudulent orders, or misuse of promotions.
No harassment of staff or other customers.
No resale of Our products for commercial gain.
No unauthorized use of Cafe Akaw’s branding, trademarks, or intellectual property.
4. ORDERS, PAYMENTS & REFUNDS4.1 Order PolicyAll orders subject to stock availability.
We reserve the right to cancel, limit, or refuse orders without explanation, including for:
Suspected fraud (e.g., stolen credit cards).
Excessive order demands (e.g., bulk orders without prior arrangement).
Past incidents (e.g., prior chargebacks, disputes, or bans).
4.2 Pricing & PaymentPrices in MYR (Malaysian Ringgit).
All prices subject to change without notice (including typos).
Payment must clear before order fulfillment.
Third-party delivery fees (Grab, FoodPanda, etc.) are NON-REFUNDABLE.
4.3 Strict Refund PolicyNO REFUNDS for:
Customer mistakes (wrong address, wrong item ordered).
"Changed my mind" after ordering.
Food/drink taste preferences (unless spoiled/inedible).
Delivery delays (blame the courier, not Us).
Partial refunds/store credit only if We confirm an error on Our part.
5. HEALTH, ALLERGIES & FOOD DISCLAIMERSAllergy Warning: We use shared equipment (nuts, dairy, gluten, etc.). NOT allergen-free.
You MUST inform staff of allergies BEFORE ordering.
Consumption at Your Own Risk:
No liability for allergic reactions, food poisoning, or health issues.
Pregnant/immunocompromised? Consult a doctor before consuming raw/undercooked items.
6. ZERO-TOLERANCE CONDUCT POLICYWe ban customers for:
Abusive behavior (yelling, threats, racism, sexual harassment).
Theft/damage (breaking furniture, stealing cutlery).
Fraud (fake complaints to get free food).
Violating health rules (e.g., smoking indoors).
We may:
Refuse service permanently.
Report You to police if necessary.
Charge You for damages + legal fees.
7. MAXIMUM LIABILITY LIMITATIONCafe Akaw, its owners, staff, and affiliates are NOT liable for:
Injuries/death from food/drinks, fights, or accidents on premises.
Lost/stolen items (bags, phones, etc.).
Delivery mishaps (late/cold/wrong orders by third parties).
Technical failures (website/app crashes, payment errors).
You agree to INDEMNIFY Us against any claims or lawsuits.
8. INTELLECTUAL PROPERTY (IP) OWNERSHIPCafe Akaw owns ALL rights to:
Logo, menu designs, photos, social media content.
"Cafe Akaw" name & branding.
NO unauthorized use (e.g., reselling Our photos, copying menu items).
9. FORCE MAJEURE (WE’RE NOT GOD)We are NOT responsible for:
Natural disasters (floods, fires).
Government lockdowns (pandemics, curfews).
Supplier failures (no coffee beans, no electricity).
10. GOVERNING LAW & LEGAL DISPUTESJurisdiction: Malaysian law (Johor Bahru courts).
Dispute Resolution:
Mediation first (We’ll try to settle privately).
If unresolved → Court case in Malaysia.
NO CLASS ACTIONS – You sue individually.
CUSTOMER ACKNOWLEDGEMENTBy ordering, dining in, or using Our Services, You CONFIRM:✅ You read, understood, and agreed to ALL terms above.✅ You waive ALL legal claims against Cafe Akaw unless proven gross negligence.✅ You consent to Our Privacy Policy & data collection.
